Information for Owners and Tenants

Before you move

New owners and tenants are asked to contact the Caretaker at least a week before moving in or out, to coordinate the installation of protective curtains in the lift.

After you have moved in

We would appreciate if you could familiarise yourself with the Strata Plan By-laws.

The Executive Committee of the Owners Corporation and the Caretaker are available to assist you with any questions.

Security − preventative measures

For Sale and For Lease Signs

For Sale and For Lease signs are generally not permitted anywhere on the Common Property. Only on the day of any Inspection, Open for Inspection signs, are permitted.

Dumping of Rubbish in the Car Wash Area

No material is to be left for collection in the Car Wash area adjacent to the Garbage Rooms, near the entrance to the car park, as the Owners Corporation is not providing or funding the collection of material that is not placed within the wheelie bins provided (By-Law 9).

CCTV footage will be used to identify any resident that leaves material inappropriately in the Car Wash or Garbage areas. Once identified the owners of the lot associated with the dumped material will be dealt with under the terms of the scheme by-laws.

Smoking

Please be advised smoking is prohibited in all common areas of the complex. Additionally please ensure any smoke stays within the confines of your lot (By Law 50 – Smoking Restrictions).

Pets

Pets are only allowed to be kept if you have the written permission of the Owners Corporation. 

While on Lexington property, always keep your pets on a leash. The car parks are not areas to exercise any pets.

Pick-up after your pets to ensure the cleanliness of the common property and the health of all residents.

Visitor Car Parking Spaces

Use of Visitor car parking spaces is limited to periods of no more than eight hours by bona fide visitors. A parking fee of $100 per hour, or part there of, applies to the use of a Visitor car parking space as detailed in By-law 8. The parking fee is the responsibility of the relevant lot owner.

If owners and residents utilise common property Visitor car parking spaces for their own cars,  it should be noted a fee applies. 

Due to DA requirements, visitor car parking spaces can not be rented. If you are in need of additional car parking spot, have a look if there is a vacant sport with one of your neighbours and approach them directly for a private arrangement. 

Car Parking spaces

Car Parking Spaces are to be kept clean and neat and are not to be used for storing any goods. They are only to be used for vehicles like bicycles, motor bikes, and passenger cars.  

Water Mains

Owners and residents that need to have the water supply to their unit suspended will need to arrange access to the tap with the Caretaker.  To have the water supply to a unit suspended in an emergency, after hour contacts are listed on the Notice Board at the Lobby and can also be found here.

Blocked Patio Drains

Cleaning of patio drains that have become blocked as a result of vegetation and dirt buildup is the responsibility and accountability of the resident and lot owner respectively.

Connecting Telephone Services, Pay TV (FOXTEL) and Internet Services

FOXTEL connections can only be provided when the Caretaker is on-site as the distribution points around the common property are protected with a restricted access key. For opening hours please see here.

The access required by a technician to install a telephone service, broadband service or Naked DSL service can only be provided when the Caretaker is on-site as the Main Distribution Frame (MDF) and other distribution points are protected with a restricted access key.

Letterbox Security

Residents should be aware that thieves have been opening and removing mail from the letterboxes.

The Executive Committee recommends owners retain a locksmith, or take their letterbox lock to a locksmith, and have it modified such that the Master Key capability is removed as well as have it re-keyed such that the key required to open the lock is different to the number stamped on the front of the lock.

Hornsby Locksmiths will undertake the work for $15.00 in their shop.

Removal and re-installation of the cam-lock from the letterbox requires no tools.

If you have had mail stolen from your letterbox the Executive Committee recommend you notify Hornsby Police on 02 9476 9799 or Crime Stoppers on 1800 333 000, your banks and service providers.

Lightbulb Replacement in common area

Unless the failure of a lightbulb in a common area creates a safety risk, replacement will be undertaken as part of the monthly site check.

Occupational Health and Safety

Under section 10 of the Occupational Health and Safety Act the Owners Corporation is under an obligation to ensure that any property that is not being used as a private dwelling (ie, inside your individual unit) are safe and free from risks.

The Owners Corporation has recently commissioned an OH&S consultant to review the complex and produce a report. The report will used by the Owners Corporation to ensure all areas of risk identified are mitigated appropriately.

The Occupational Health and Safety Act 2000 (the OHS Act) prescribes obligations on persons who control premises used by people as a place of work to “ensure that the premises are safe and without risks to health”. These obligations are similar to the responsibilities on owners corporations under the Strata Schemes Management Act which require owners corporations or their delegated agents, to maintain premises in a safe condition.

WorkCover has not applied the controllers duties under the OHS Act 2000 to such common property in the past, as it has always considered the common property to be ancillary to the primary function of strata units, which is use as residential private dwellings.

Owners corporations have the responsibility to maintain and keep the common area in a state of good repair under Section 62(1) of the Strata Scheme Management Act . WorkCover considers that these responsibilities are reasonable and sufficient for owners corporations of residential strata schemes to meet the obligations they may have under the Occupational Health and Safety Act 2000.

Report an Incident

Report any incident you consider needs to brought to the attention of the Secretary of the Owners Corporation and the Caretaker as soon as practicable after the incident.
